Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Allu Limited, trading as Fmly.Club, ("we," "us," or "our"). By accessing or using Fmly.Club, you agree to be bound by these Terms, our Privacy Policy, our Cookie Policy, and our Refund Policy. If you do not agree, do not use the app.

Fmly.Club is a household coordination app for chores, routines, calendars, and rewards. Core features run entirely on your device; backup, recovery, and multi-device sync are the parts that use our servers. Fmly.Club is not a medical, therapeutic, diagnostic, educational, or professional-advice product, and nothing in it should be treated as such.

You must be at least 18 years old to create a household. By creating a household, you represent that you are an adult and that you have the legal authority to agree to these Terms on behalf of your household.

Children under 13 may use Fmly.Club only as members of a household created and supervised by an adult. The adult who creates the household is responsible for providing any required parental consent under applicable law, including the Children's Online Privacy Protection Act (COPPA). If you add children as members of your household, you confirm that you are their parent or legal guardian, or that you have the permission of their parent or guardian. You are responsible for the content you enter about children (including nicknames, chores, points, and rewards) and for obtaining any consent required from the other parent or guardian before doing so. Children do not enter their own information; you control every member entry.

A household is shared by the people who use it. You are responsible for keeping your household PIN and your devices secure, and for the activity of everyone you give access to. Sensitive actions are PIN-gated, but the PIN is only as private as you keep it.

Fmly.Club, including its design, code, branding, and content, is owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use Fmly.Club for personal, non-commercial household coordination purposes. You may not copy, modify, distribute, reverse-engineer, or create derivative works from Fmly.Club except as expressly permitted by law.

Your household data (chores, schedules, member nicknames, and other content you enter) remains yours. You grant us only the rights necessary to provide and improve the service.

Fmly.Club offers a free plan and a Pro paid plan (monthly and annual billing). New subscribers receive a free trial of 30 days; no charge is made until the trial ends, and you may cancel before it ends without being charged. All paid plans auto-renew at the then-current price until cancelled. You can cancel at any time through the Stripe Customer Portal (Manage, then Manage subscription); cancelling stops future renewals and Pro access continues until the end of the period you have already paid for.

Payments for a current monthly period are non-refundable. For annual plans, you can request a full refund within 14 days of an annual charge by emailing support@fmly.club. We will give at least 30 days' notice before any price increase takes effect on an active subscription. Prices and taxes

Prices are shown and charged in US dollars (USD). The price displayed is the amount charged; we do not currently add sales tax, GST, or VAT at checkout. Depending on where you live, you may be responsible for any taxes that apply to your purchase.

Your family's data is yours. By default your board is stored in your browser's local storage on your own device, and backup, recovery, and multi-device sync are the features that place a copy on our servers. You can export a complete copy of everything we hold on our servers at any time (Manage, then Your data, then Download your data) and delete your household entirely from within the app.

You are responsible for keeping your own backups. Data held in your browser's local storage can be erased without warning - for example if you or your browser clear site data, reset or switch browsers, use private or incognito mode, update or reinstall software, or if your device is lost, damaged, or replaced. A board that exists only on your device cannot be recovered by us, because we never held a copy. We are not responsible for any loss, corruption, or unavailability of your data, whether it is stored in your browser's local storage or on our servers, and whether caused by device failure, browser or operating-system behaviour, your own actions, software updates, errors or bugs in Fmly.Club, network issues, or any other cause. Keep your recovery email current and download a copy of your data regularly. See our Privacy Policy for details on what is collected and how it is handled.

Use Fmly.Club for coordinating your own household. You agree not to: attempt to break its access controls; disrupt the service for others; use it to harm anyone; use automated systems to access the service; or use it for any unlawful purpose.

We strive to keep Fmly.Club available but do not guarantee uninterrupted or error-free operation. We may suspend or discontinue the service (or any part of it) at any time with reasonable notice. For device-only usage, availability depends on your device.

To the extent permitted by applicable law, Fmly.Club is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will meet your requirements or be available on an uninterrupted, secure, or error-free basis.

To the maximum extent permitted by applicable law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or in connection with these Terms or your use of Fmly.Club. Without limiting the foregoing, we shall not be liable for any loss, corruption, or unavailability of your data - including data stored in your browser's local storage that is deleted or lost through the browser, device loss or failure, clearing site data, private or incognito browsing, software updates, or errors or bugs in Fmly.Club - regardless of the cause. You are responsible for maintaining your own backups.

Our total aggregate liability for all claims arising out of or relating to these Terms or the service shall not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) $50 USD.

Mandatory consumer rights: nothing in these Terms excludes, restricts, or modifies any right or guarantee that cannot be excluded under the Consumer Guarantees Act 1993 (NZ), the Fair Trading Act 1986 (NZ), or any equivalent mandatory consumer-protection law that applies where you live. The disclaimers and limitations above apply only to the extent that law permits.

You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of Fmly.Club, your violation of these Terms, or your violation of any rights of a third party.

We encourage you to contact us first at privacy@fmly.club to resolve any dispute informally. If we cannot resolve the dispute within 30 days, either party may propose binding arbitration administered by a mutually agreed arbitration provider under its rules then in effect. Arbitration proceeds only if both parties agree to it.

Class action waiver: you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this waiver is found unenforceable, the entirety of this arbitration provision shall be void.

Small claims exception: either party may bring an individual action in small claims court for disputes within its jurisdiction.

Consumer-law exception: nothing in this section prevents you from exercising any right to bring a claim, or to use a dispute-resolution or complaints process, that applies to you under mandatory consumer-protection law and cannot be waived.

These Terms are governed by and construed in accordance with the laws of New Zealand, without regard to its conflict-of-law provisions. Any legal proceedings not subject to arbitration shall be brought exclusively in the courts of New Zealand, and you consent to the personal jurisdiction of such courts.

You can stop using Fmly.Club and delete your household at any time. We may suspend or terminate your access if you violate these Terms or applicable law. Upon termination, your right to use Fmly.Club ceases immediately, but you may export your data before deletion.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms with a new effective date and, where possible, via an in-app notice or email to the household owner. Your continued use of Fmly.Club after the updated Terms take effect constitutes your acceptance of the changes.

Entire agreement: these Terms, the Privacy Policy, the Cookie Policy, and the Refund Policy constitute the entire agreement between you and us regarding Fmly.Club, superseding any prior agreements.

Severability: if any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

Waiver: our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment: you may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
